{"id":105,"date":"2024-12-10T07:44:19","date_gmt":"2024-12-10T07:44:19","guid":{"rendered":"https:\/\/legalandlegalassociates.com\/blog\/?p=105"},"modified":"2024-12-23T09:33:38","modified_gmt":"2024-12-23T09:33:38","slug":"article-21-of-the-constitution-of-india-guarantees-the-right-to-life-and-personal-liberty","status":"publish","type":"post","link":"https:\/\/legalandlegalassociates.com\/blog\/article-21-of-the-constitution-of-india-guarantees-the-right-to-life-and-personal-liberty\/","title":{"rendered":"Article 21 of the Constitution of India\u00a0guarantees the right to life and personal liberty:"},"content":{"rendered":"\n<p>Article 21 of the Constitution of India&nbsp;<mark>guarantees the right to life and personal liberty<\/mark>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>No person can be deprived of their life or personal liberty except in accordance with a procedure established by law.<\/li>\n\n\n\n<li>No person can be denied equality before the law or equal protection of the laws within India.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>The state refers to all entities with statutory authority, such as the government, parliament, and local authorities.&nbsp;Violation of the right by private entities is not within its purview.&nbsp;<\/p>\n\n\n\n<p>Article 21 also imposes an obligation on the state to:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Preserve life\u00a0<\/li>\n\n\n\n<li>Provide adequate medical facilities for the people\u00a0<\/li>\n\n\n\n<li>Ensure that the procedure prescribed by law for depriving a person of their liberty is &#8220;reasonable fair or just&#8221;\u00a0<\/li>\n<\/ul>\n\n\n\n<p>The right to life and personal liberty was debated in the Constituent Assembly on December 6 and 13, 1948.
