Section 6 – Aggravated Penetrative Sexual Assault (POCSO Act, 2012)

Section 6 – Aggravated Penetrative Sexual Assault (POCSO Act, 2012)

What it Means:

Section 6 of the Protection of Children from Sexual Offences (POCSO) Act, 2012 deals with aggravated penetrative sexual assault on a child — the most serious forms of sexual violence involving penetration.

This includes cases where:

  • The assault causes death, severe injury, or leaves the child in a vegetative state.
  • The offender is in a position of authority or trust (e.g., police officer, doctor, family member, teacher, etc.).
  • Weapons, threats, gang assault, or repeat offences are involved.

⚖️ Punishment Under Section 6:

  • Minimum Imprisonment: 20 years
  • Maximum Punishment: Life imprisonment (meaning the entire natural life) or death penalty (in the rarest of rare cases)
  • Fine: The court may impose a monetary fine — meant to be used for the child victim’s medical treatment and rehabilitation.

🧒 Why It Matters:

Section 6 ensures strict punishment for the most heinous crimes against children, offering zero tolerance for brutality and reinforcing child protection laws in India.

🗣️ Legal Insight by Dr. Anthony Raju, Advocate Supreme Court & POCSO Law Expert:

“Section 6 is the backbone of child protection law when dealing with the worst forms of abuse. It sends a strong message that crimes against children will be met with the severest punishment under the law. However, false implications under this section can also ruin innocent lives, and the law must be enforced with both sensitivity and scrutiny.”
