Legal Remedies by Dr. Anthony Raju | Supreme Court Advocate | Human Rights Expert
🔍 INTRODUCTION
Facing injustice but the police refuse to register your FIR?
This is a serious violation of your fundamental and legal rights. Here’s how to file an FIR and what legal options you have if police deny it, explained by Dr. Anthony Raju, Top Criminal & Constitutional Lawyer and Chairman, All India Council of Human Rights, Liberties & Social Justice (AICHLS).
⚖️ What is an FIR (First Information Report)?
FIR is the first step in criminal justice under Section 154 CrPC.
Mandatory for police to register FIR in cognizable offences like:
Rape
POCSO (Child Sexual Abuse)
Dowry Death
Attempt to Murder
Domestic Violence
Medical Negligence
Cybercrime
Refusal to file an FIR amounts to denial of justice and violation of Article 14 & Article 21 of the Indian Constitution.
🛡️ Legal Remedies If Police Denies Lodging FIR
1️⃣ Approach Superintendent of Police (SP) – Section 154(3) CrPC
Submit a written complaint to the SP. They can order FIR registration by concerned police station.
2️⃣ File Before Judicial Magistrate – Section 156(3) CrPC
Approach the Magistrate Court with a complaint. The court can direct police to register FIR and investigate.
3️⃣ Complain to State/National Human Rights Commission
For serious violations and police misconduct, lodge a complaint with:
State Human Rights Commission
NHRC India
4️⃣ File Writ Petition in High Court – Article 226
When all else fails, approach High Court under Article 226. The court can:
Order police to file FIR
Order special investigation (CBI/SIT)
Grant protection to victims
🧑⚖️ Expert Legal Insight – Dr. Anthony Raju Says:
“If a victim is denied FIR registration in cases like rape, molestation, child abuse, or any cognizable offence, it’s not only illegal, but a brutal denial of dignity and justice. Never stay silent — assert your legal rights!”
